Cardwel l Chetham covenanted with the trustees to pay the annual premiums, to keep the policy on foot, and not to do anything whereby the policy might become void; and it was declared that the trustees might, if they should think fit, apply any part of the income, or, if that should be insufficient, any part of the capital of the trust property, iu payment of the premiums. Notice of the assignment of the policy by that deed was immediately given to the assurance company. By an indenture dated the 31st of October, 1866, between Mrs. Chetham, Mrs. Greaves, and the Plaintiffs, which recited the settlement of 1847; that the Plaintiff Gill had advanced Mrs. Greaves moneys on the security of her promissory note, and, as was intended, on the collateral security of Mrs. Chetham, under the power of appointment in the settlement (which, with the policy, was left with the Plaintiff Gill) that the Plaintiff GUI had advanced other moneys on the like security; that the Plaintiff Wilkinson had advanced moneys to Mrs. Greaves, with interest at 5 per cent., Mrs. Chetham having agreed to secure the repayment of the same by an' assignment of the policy, and Mrs. Greaves having given a bond for the same; that the Plaintiff had paid one half-yearly premium on the policy, and that all the moneys advanced (in the aggregate £509 48. Id.) were owing; Mrs. Chetham appointed that the policy and the moneys to become due by virtue thereof should be held by the trustees of the settlement for the benefit of the Plaintiffs Gill and Wilkinson, their executors, &c.; that the Plaintiffs should be paid by the trustees auy sum which they or either of them had advanced for the payment of the premiums, with interest at 5 per cent, and expenses, and also the princi...
